She has also said she would never hurt their child and described herself as a domestic violence victim and advocate rather than a perpetrator.A judge previously granted Martinez’s request for a temporary restraining order, while Berry retained final decision-making authority over Maceo’s mental health and education.
Her parenting time was temporarily modified as the custody dispute continues.Berry has also asked the court to restore the 50-50 custody arrangement she previously shared with Martinez.
She has accused her ex-husband of interfering with their son’s therapy and education and of contributing to conflict between her and Maceo.
Martinez has denied wrongdoing and said his actions are motivated by concern for their son’s welfare.The former couple had previously participated in co-parenting therapy in 2024 after agreeing to work with a parenting coach to resolve disputes and improve their relationship as co-parents.The latest filing comes ahead of the former couple’s next court hearing, which is scheduled for October 16.
The custody arrangements and allegations remain subject to the ongoing legal proceedings.
Berry had completed the “Our Children First” online mediation orientation and parent education programme.
